How Tennessee Defines Burglary
Under TCA 39-14-402, burglary occurs when a person, without the owner’s effective consent, enters a building or vehicle with the intent to commit a felony, theft, or assault inside, or enters and actually commits or attempts such an offense. The prosecution doesn’t need to prove a crime was completed. Intent at the moment of entry can be sufficient, and intent is one of the most commonly contested elements in these cases.
Tennessee law defines entry broadly. Any intrusion of part of the body counts, and breaking a lock or window isn’t required. Walking through an unlocked door with criminal intent, or remaining inside a business after closing with that intent, qualifies under the statute.
The three levels of the charge carry distinct classifications:
- Standard burglary of a non-residential building is a Class D felony. Vehicle burglary under the same statute is a Class E felony.
- Aggravated burglary under TCA 39-14-403 involves a habitation: a home, apartment, or mobile home. This is a Class C felony.
- Especially aggravated burglary under TCA 39-14-404 applies when a victim suffers serious bodily injury during the offense. This is a Class B felony.
Sentencing Ranges for Burglary Convictions in Tennessee
Tennessee uses a structured sentencing framework. A defendant’s prior criminal history, whether the property was occupied, and the value of property involved all influence where within a statutory range a sentence falls.
- Class E felony (vehicle burglary): 1 to 6 years and fines up to $3,000
- Class D felony (standard building burglary): 2 to 12 years and fines up to $5,000
- Class C felony (aggravated burglary): 3 to 15 years and fines up to $10,000
- Class B felony (especially aggravated burglary): 8 to 30 years and fines up to $25,000
A felony conviction is permanent. It appears on background checks run by employers, landlords, and professional licensing boards long after a sentence is served.
